The outside lawyer secured by the City did an outstanding job of negotiating a settlement with RioCan (the Home Sense Plaza), which was approved by the OMB. He also presented a strong case, along with the planning witness for the City and testimony from several residents opposing the height, which the OMB preferred, resulting in the appeal being dismissed on the Lakeshore Rd. W. properties, on the south side, just west of Meadow Wood Rd.
This means that the Council decision to restrict the building height to 4 storeys, rather than the requested 6 storeys, will stand. The OMB was persuaded by the existing physical context and the proposed planning regime for the remainder of the Clarkson Village area, that a 6 storey height would result in disjointed development, which would not be harmonious with adjoining lands.
Our strategy to narrow the scope to what we could defend at the OMB was successful and I am pleased that we now have finality on these matters and it is time to look forward to an exciting future for Clarkson Village!
